ParticipantToday I was shocked to see Impeka is gone from Envato Marketplace. What happened? Hopefully only a temporary situation.

Hi @hiegh,
Yes, it is frustrating for our team, mainly because Envato didn’t inform us about the trademark issue – https://hub.greatives.eu/forums/topic/impeka-trademark-issue/. To be honest, all this makes no sense as Impeka was published on 20 April while they registered the trademark IMPEKA on 17 September. It’s just a theme name and we cannot do anything different of course.
However, there is nothing to worry about as we have already made the required changes (renamed it IMPEKKA). I am optimistic that it will be available again within a few hours. Thanks again for your support 🙂

We still cannot believe what we are facing. I am wondering, can anyone do the same for any other popular theme in the marketplace? This is a small company in Canada that decided to register the Trademark IMPEKA six months later. Besides that, the document they sent is just an application that has not yet been assigned to an examiner.
We resubmitted IMPEKKA, sent several emails to Envato but still no luck. This is frustrating, especially for a team that strictly follows all official guidelines.

This nightmare adds to the overall problematic way, how Envato handles this. I saw a lot of developers leave the platform for similar horrible experiences. It’s a shame, such things could happen. There are a lot of themes, that use names, which are of course trademarked somewhere in the world. Would be interesting to know, how Envato acted here. Are you allowed to disclose some details?
Anyway, let’s look forward to a bright future for Impekka, as this theme really deserves it. 🙂

Just want to mention here, I have to agree with @hiegl. Envato is not the type of company we want to support through their commissions/fees. They do not care about their creators at all, this is a fact. Any author will be confrontated with their practices. Sooner or later.
I remember, I had a chat with @Kosmas around 1.5 years ago about exactly that topic and if there is any chance to purchase their themes on another -or their own- platform, since any penny that goes to Envato through a purchase, I highly regret.
Just read this message I sent back then and this is just a 1:1 confirmation for me – again (stopped counting).However, I understand their decision being an exclusive author on this platform and wish them all the best for the future.
For me, I will avoid this platform at all costs. Would have a better conscience if I could tell my clients to buy their themes on another place.October 7, 2021 at 8:49 am #520Hi guys,

We are still discussing (we hope so) this issue with Envato. It seems that the agent who received that document didn’t follow the normal process. I have to wait for their official answers in a couple of more things.
I agree with you @Marius1989, things are getting worst month by month in the marketplace. Indeed, this is something that we already discussed a long time ago.
I’ll keep you posted.

I apologise for the delay but there were so many things to sort. In general, it was a nightmare.
As you have already noticed, Impeka has its former name again. They apologised to us, it’s obvious that they made a terrible mistake. We have already asked for more explanations as we are very disappointed.Maybe it’s time to reconsider many things.

You could police licenses (1 per site) easier that way.
